Digital signature software sometimes means any electronic-signing service, but a cryptographic digital signature is a more specific requirement. First ask whether a lender, registry or other recipient requires a certificate-based signature or simply accepts an electronic signing process. Those requirements lead to different tests.
First ask the recipient what it accepts
Ask which document formats, certificate issuers, identity checks and validation rules the recipient accepts. Confirm whether remote notarization or a separate filing process is needed. Do not infer the requirement from the word digital in a marketing page.
A certificate links a key and identity—not every authority
For certificate-based signing, ask how the signing key is protected, who can activate it and how authority is established. Check certificate issuance, expiry and revocation handling. A certificate can associate a key with an identity under an issuer’s policy; it does not independently establish a person’s authority to act for an entity.
A hypothetical recipient requires a particular signed-PDF validation policy. Tool A creates a visible signature image; tool B produces a certificate-based file accepted by the recipient’s test validator. If that policy is mandatory, A fails even if it is easier to use. This example does not claim that a specific product meets a recipient’s requirements.
Validate the exported file outside the sender account
Use the intended recipient’s validator or agreed validation process. Check signer information, document integrity and any timestamp evidence. Test an altered copy and an expired or revoked certificate case with the provider’s approved test method. Do not rely solely on the sender platform’s green badge.
Digital signatures do not encrypt the document’s contents by themselves and do not make every contract valid. Trust depends on the implementation, issuer, key protection and applicable requirements. Specialist technical or legal advice may be needed for long-term validation and cross-border use.
Preserve validation evidence for the required lifetime
Ask how validation evidence is preserved and what remains usable after account cancellation. Price certificates, identity verification, timestamps, users, requests and recipient support. Keep the signed original file intact; printing and rescanning does not preserve cryptographic validation.
- Recipient specification documented.
- Key, certificate and authority controls distinguished.
- Export validated outside the sending service.
- Alteration and certificate-status handling tested.
- Long-term evidence and full cost understood.
The technology-neutral definition in 15 U.S.C. § 7006(5) does not require every electronic signature to use a certificate. Match the technical requirement to the actual transaction.
