Good real estate document management means being able to explain what a file is, where it came from and why it is retained. A well-named folder helps retrieval, but it does not replace version history, permissions or a retention decision.
Intake, document state and the operative record
Assign a transaction identifier and a document type. Use a consistent naming pattern such as transaction-ID_document-type_version_state. Keep drafts, approved copies and executed records distinguishable. Record the source and received date for outside documents.
Do not overwrite a signed record with a later correction. Link amendments to the document they change, and identify the currently operative set without hiding earlier versions. Restrict who can edit templates or change a record’s state.
In a hypothetical file, purchase agreement v2 is executed and a later addendum changes the closing date. The index points users to v2 plus the addendum as the operative set. It does not rename the addendum v3 and delete v2. A reviewer can reconstruct both the original commitment and the later change.
Retention rules need an owner—not a universal number
Have the responsible records or compliance owner identify applicable brokerage, regulatory, contractual and other requirements. Assign retention rules by record category and trigger. Suspend routine disposal when a preservation obligation or legal hold applies. Do not invent a single universal retention period.
Scanning does not automatically authorize destruction of paper originals. Retention, privacy and preservation duties may conflict and need qualified resolution. A system’s storage period is not the same as the office’s legally applicable retention rule.
Prove retrieval before authorizing disposal
Select a closed sample file and retrieve the executed agreement, amendments, relevant notices and available signing evidence. Check readability after export. When disposal is authorized, record what was removed, under which rule and by whom, including the treatment of duplicate copies and backups.
- Document types and naming rules agreed.
- Draft and executed states clearly separated.
- Amendments linked without overwriting originals.
- Retention and hold decisions assigned to an owner.
- Exported closed-file package is readable and complete.
15 U.S.C. § 7001(d) addresses accuracy, accessibility and reproducibility when electronic records satisfy retention requirements; it does not create a universal retention duration.
